TERMS OF SERVICE

1. Introduction

1.1  These terms and conditions (hereafter “T&C’s”) outline the rules and regulations for the use of CoreCo (Pty) Ltd (Reg No. 2023/223561/07 (hereafter “CoreCo”) website, located at www.coreco.co.za (“Online Shop”). By accessing or using our Online Shop, you agree to be bound by these T&C’s.

 

1.2  By making a payment on any invoice issued by CoreCo, the Customer acknowledges and agrees to be bound by these T&C’s.

 

2. Order Placement

 

2.1  Each order is subject to CoreCo’ acceptance, and we reserve the right to limit or refuse any order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order as aligned with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). This acceptance will be conveyed through an electronic confirmation, such as an email or on-screen confirmation. 

 

2.2 Pre-orders for our products are accepted subject to availability. A full payment or a deposit, as specified at the time of the pre-order, is required to secure your order. CoreCo reserves the right to make changes to the specifications or design of the pre-ordered products. If significant changes are made, you will be notified, and you may choose to cancel the pre-order for a full refund.

 

2.3  It is the Customer's responsibility to provide accurate and complete information when placing an order. Additionally, the Customer must ensure that the order details are correct before finalising the purchase. 

 

2.4  CoreCo will not be held liable for any errors in the information provided or for any issues arising from incorrect order placement.

 

3. Pricing and Payment

 

3.1  All prices are listed in South African Rand (ZAR) and are inclusive of associated shipping costs.

 

3.2  Payment must be made in full at the time of ordering through the accepted payment methods provided on our website. Should the Customer receive an invoice as payment method, the invoice must be paid in full within 5 business days of issuance. After this period, the invoice will no longer be valid, and the order may be cancelled at the discretion of CoreCo.

 

3.3  Where payment is made via electronic transfer, payment shall be paid into the following designated bank account of the CoreCo:

3.4  The Customer agrees to ensure that payments are made only to the designated bank account provided by the Company in clause 3.3 of the T&C’s. The Customer accepts sole responsibility for confirming the accuracy of the bank account details prior to any transfer of funds. The Company commits that it will not change its bank account details without providing prior formal written notification to the Customer. 

 

3.5  In instances where international payments are required, it is incumbent upon the Customer to ensure timely remittance of funds, bearing in mind that all associated bank and/or transfer fees are the responsibility of the Customer.

 

3.6  Please note that prices are subject to change without notice; however, such changes will not affect orders that have already been accepted.

 

 4. Shipping and Delivery

 

4.1  CoreCo will endeavour to ship all orders within 3 to 7 business days. Delivery times may vary based on your location and the shipping method chosen.

 

4.2  CoreCo will not be liable for any delays in shipping due to the courier service or any other unforeseen circumstances.

 

5. Returns and Refunds

 

5.1  If you are not satisfied with your purchase, you may return the product within 5 business days of receipt for a refund or exchange, provided the product is in its original condition and packaging.

 

5.2  The buyer is responsible for return shipping and handling costs unless the product is defective or incorrect.

 

6. Warranty

 

6.1  Our Pilates reformer machines come with the following warranty against manufacturing defects:

  • Frame: 10 years

  • Springs and Moving Parts: 2 years

  • Fabric and Upholstery: Replaced if they fail under normal use within 90 calendar days of purchase

 

6.2  The damage will be inspected by CoreCo and we will have the discretion to decide on the validity of the claim. This warranty does not cover normal wear and tear, misuse, or damage caused by improper use.

 

6.3  To claim a warranty, please contact our customer service with proof of purchase and a description of the defect.

 

 7. Limitation of Liability

 

7.1  CoreCo shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase, use, or performance of the products.

 

8. Personal Information Compliance

 

8.1  CoreCo acknowledges and respects the importance of protecting personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPI Act).

 

8.2  By providing your personal information to us, you consent to its collection, processing, and storage for the purposes of fulfilling your order, communicating with you about our products and services, and complying with legal obligations. We will not share your personal information with third parties unless required by law or with your explicit consent. You have the right to request access to, correction of, or deletion of your personal information held by us.

 

9. General

 

9.1  Neither party shall be held responsible for any failure to perform its obligations under this Agreement if such failure is due to events beyond its reasonable control, including but not limited to acts of God, fires, floods, strikes, labour disputes, war, terrorism, government regulations, or any other cause beyond the control of the parties. In the event of a force majeure event, the affected party shall promptly notify the other party of the circumstances and the anticipated impact on performance. The parties agree to make reasonable efforts to mitigate the effects of the force majeure event and to resume performance under this Agreement as soon as practicable.

 

9.2  All content, including but not limited to text, images, logos, and designs, displayed on the CoreCo website and associated materials are the intellectual property of CoreCo and protected by copyright laws. Any unauthorised use, reproduction, or distribution of our intellectual property is strictly prohibited.

 

9.3  These T&C’s shall be governed by and construed in accordance with the laws of the Republic of South Africa. 

 

9.4  If any provision of these T&C’s are found to be invalid, illegal, or unenforceable under any applicable law, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way. The parties agree to negotiate in good faith to replace the invalid or unenforceable provision with a valid and enforceable provision that reflects the original intent of the parties.
